ADU Permits in Monterey: The 2026 Process, Fees, and Timeline

In the City of Monterey, your ADU permit rides on the California state baseline: a detached ADU of up to 1,200 square feet on nearly any single-family lot, 4 foot side and rear setbacks, and ministerial approval within 60 days of a complete application, all guaranteed by state law (Government Code sections 66310 to 66342). Monterey runs its own permit counter and its own process details, but it cannot subtract from those protections.

The short version: Monterey follows the state ADU baseline, and state law preempts any stricter local rule. Every lot is guaranteed at least an 800 square foot, 16 foot tall ADU. The local texture that matters here is Monterey’s older housing stock, its historic areas, and coastal-zone parcels, which shape process more than outcome. We confirm the local specifics for your address free, and we run the entire permit, with a permitting budget built into one project price.

The Monterey ADU permit process, step by step

  1. Start from the state floor. No matter the zoning details, state law entitles nearly every single-family lot to an ADU: up to 1,200 square feet detached, never less than 800 square feet, 16 feet of height, 4 foot side and rear setbacks, and no owner-occupancy requirement. Our Can I build? rules lookup shows the citations.
  2. Identify your overlays. Monterey has historic districts, coastal-influenced parcels, and hillside streets from Monterey Vista to Skyline Forest. Overlays can add review steps or objective design standards; they cannot take away your state-guaranteed unit.
  3. Design and engineer the plans. Site plan, floor plans, structural, and Title 24 energy documentation, drawn to survive plan check the first time. The 60-day ministerial clock only starts on a complete application.
  4. Submit to the city and manage plan check. Ministerial review means the city checks objective standards, no hearing, no neighbor approval.
  5. Permit, then inspections. Foundation, utilities, and final inspection as the home is delivered and connected.

If we build your ADU, all five steps are ours, and a permitting budget is built into the one project price. Your exact permit fees are set by the city and confirmed in your feasibility study.

What is genuinely local about Monterey

Lots are older and tighter. Much of Monterey was platted long before ADUs existed, so the design question is usually placement: where a unit fits between setbacks, existing structures, and mature trees. State law helps: a garage can be replaced with an ADU, and parking exemptions apply broadly, including within a half mile of transit.

History and the coast. If your home sits in a historic district or a coastal-influenced area, expect an extra layer of objective review. It changes the paperwork, not your right to build.

The county line matters. Just outside city limits, unincorporated Monterey County applies its own version of the rules and even offers three free pre-designed ADU plans. If your address is county, start with our Monterey County ADU regulations guide instead.

Monterey ADU fees

State law waives impact fees for ADUs under 750 square feet; at 750 square feet or larger, fees must be proportional to the primary home. Six of our 14 models stay under that line, including the 450 square foot studio at $199,000 and the 749 square foot two-bedroom at $369,000, all-inclusive of construction. Full local pricing is in our ADU cost in Monterey guide.

How long the permit takes

Expect the 60-day ministerial window from a complete application, with historic or coastal overlays adding lead time in front of it. Permit timing is the city’s to give, not ours, so we never promise a delivery date off a permit estimate. What we do control: your home is built about 97% complete in our Salinas factory, about 25 minutes away, while the paperwork runs. The full schedule is in our Monterey ADU timeline guide.

Frequently asked questions

Does Monterey have its own ADU size limits?

The state baseline governs: up to 1,200 square feet detached, and every lot guaranteed at least 800 square feet. Any local standard that would prevent an 800 square foot ADU must yield to state law. We verify the specifics that apply to your parcel during the free property analysis.

My house is in a historic district. Can I still build?

Almost always yes. Historic overlays add objective design review, but they cannot eliminate your state-guaranteed ADU. The design just needs to be drawn with the overlay in mind from day one.

Do I need parking for a Monterey ADU?

At most one space, and the state exemptions are broad: within a half mile walking distance of transit, replacing a garage, or converting existing space all waive it. Many Monterey lots qualify.

Do I need to live on the property?

No. Owner-occupancy is not required for a standard ADU and cities cannot impose it. A JADU, the under-500-square-foot unit inside your home’s existing walls, requires it only when the unit shares a bathroom with the main home.
